Definitions
“Credit Limit” means such sum as Select Telecom notify to the customer (verbally or in writing for) a maximum total order price
“Delivery Charge” means such charge incurred by Select Telecom in forwarding the product to the customer
“Product” means one or more of the following in combination or otherwise:-
Services or repair, installation and maintenance, accessories and equipment, mobile telephones plus Service Provider Contract, mobile telephone only or a pay as you go mobile telephone
“Service Provider” means a provider of airtime on a mobile telephone network
“Select Telecom” means a business providing access to both a Service Provider and the Product
- The Customer shall purchase the Product at the price set by Select Telecom at the date the Customers order is accepted by Select Telecom.
- Select Telecom shall confirm the order (whether or not the initial order is either verbal or in writing and (if appropriate) the customer will provide a purchase order number.
- Select Telecom reserve the right to incur a Delivery Charge which shall be payable in addition to the price of the Product.
- Customers may be subject to a credit reference check and Select Telecom reserve the right to refuse an order as a consequence.
- (a). Customers shall have for 14 calendar days after the date of the order a cooling off period to return a mobile telephone only.
(b). Select Telecom will not accept the return of any Product (other than in (a) above) unless the Product is shown to be defective.
- The acceptance of any order for Product by Select Telecom does not guarantee any subsequent orders shall be accepted.
- Any items of Product missing from any order must be notified to Select Telecom in writing by Fax or e-mail by 4.30pm the next working day. Such notice must be received by Select Telecom to be valid.
- In the event of a subsidy having been paid by the Service Provider to Select Telecom the customer shall in the event of either :-
- No or minimal outbound usage or the Product is disconnected for whatever reason.
- The customer fails to pay any sums due to the Service Provider.
- The connection is subsequently identified as fraudulent.
- The Product not being used with the telephone number provided or the SIM card provided (Up to a maximum period of 120 days from the acceptance of the order by Select Telecom)
- return the Product
- refund to Select Telecom the SIM free market value of any mobile telephone
- refund the value of the subsidy received by Select Telecom from the Service Provider
- pay a penalty of £100.00 towards the costs and expenses incurred by Select Telecom
- All prices are quoted exclusive of VAT which where applicable is payable by the customer.
- All money payable to Select Telecom shall become immediately due upon any of the following :-
- 30 calendar days from the date of the invoice.
- A surcharge of 15% plus VAT will be incurred on late payments. The surcharge plus VAT and all other legal fees incurred will be the responsibility of the customer.
- All goods supplied remain the property of Select Telecom until FULL payment is received.
- The customer (if an individual) is made bankrupt or reaches any type of agreement for the compromise of any debts or has a County Court Judgment registered against them.
- The customer (if a Company) is wound up either compulsory or voluntarily (except for the purchase of amalgamation or re-construction) or had any judgment enforced against any of its assets.
- Select Telecom receives information under The Mobile Communication Crime Prevention Scheme operated by the Federation of Communication Service Limited as to the good standing of the customer.
- Select Telecom shall not be liable for any loss or damage to the customer if it is prevented from performing its obligations hereunder by force major shortage of supply any failure by the Service Provider or for any other reason beyond its control.
- The Product shall remain the property of Select Telecom until all invoice and Delivery Charges are paid in full and Select Telecom shall be entitled through any authorised representative to enter the customer’s property/premises (with others or alone) to take possession of the Product with all reasonable assistance required from the customer to that end.
- These Terms and Conditions are covered by the Law of England and Wales.
- The customer’s statutory rights are unaffected.
- The Terms and Conditions of the Service Provider shall be incorporated herein provided they are not inconsistent with these Terms and Conditions and in the event of such a conflict these Terms and Conditions shall apply.
